AGREEMENT TO OUR LEGAL TERMS

We are DETAILERDASH LLC ("Company," "we," "us," "our"), a company registered in Illinois, United States at 9124 Falcon Ridge Dr, Bridgeview, IL 60455.
We operate the website http://www.DetailerDASH.com (the "Site"), the mobile application DetailerDASH (the "App"), and related services (collectively, the "Services").

We’ve replaced the aggressive mechanical brushes of the tunnel wash with a precise, hand-detailed approach. Using professional-grade formulas and engineered techniques, our pros ensure your vehicle gets the specific attention it deserves without the risk of swirl marks. Book in seconds, track your pro in real-time, and enjoy a showroom finish.

These Legal Terms constitute a legally binding agreement concerning your access to and use of the Services. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. We will provide prior notice of scheduled changes. Emergency updates to insurance requirements, safety protocols, or platform integrity measures (including anti-fraud and Evidence Vault requirements) will be effective immediately. The Services are intended for users who are at least 18 years old.

1. OUR SERVICES & REGULATORY COMPLIANCE

1.1 Environmental Compliance & Zero-Runoff Policy

All Users acknowledge that mobile detailing operations are subject to the Federal Clean Water Act and local Illinois environmental ordinances.

  • DASH pro Responsibility: Service providers agree to utilize water-wise techniques (such as rinseless or low-moisture methods) or authorized containment systems to ensure that no "pollutants" (including soaps, detergents, or oils) enter the municipal storm drain system.
  • Compliance: Failure to adhere to "Zero-Runoff" standards may result in immediate account termination and personal liability for any environmental fines.

1.2 Labor Compliance & Independent Contractor Status

In accordance with the Illinois "ABC Test" for worker classification, the DASH pro acknowledges and agrees:

  • They are engaged as an Independent Contractor, not an employee of DETAILERDASH LLC.
  • They maintain full control and direction over the performance of the "Shine" or "Refresh."
  • They are engaged in an independently established trade or profession and provide their own professional-grade equipment and insurance.

1.3 Chemical Safety & Hazard Communication (OSHA)

DASH pros warrant they are trained in the safe handling of all professional-grade chemicals. Pros must maintain access to Safety Data Sheets (SDS) for all products utilized on-site and utilize appropriate Personal Protective Equipment (PPE).

1.4 Communication Compliance (TCPA & CTIA)

By providing a mobile number, Users provide express written consent to receive automated service-related communications (e.g., "En Route" updates, security alerts). Users may opt-out by replying "STOP."

1.5 Local Licensing & Authorized Locations

DASH pros warrant they hold necessary local business licenses/permits. Neighbors must ensure that the location provided for a "Shine" is a legally authorized area where mobile detailing is permitted.

1.6 Consumer Protection & Pricing Integrity

The platform prohibits "Bait and Switch" pricing.

  • CAT Verification: If a DASH pro determines a vehicle belongs to a higher Category (CAT 1-3) than booked, they must initialize a "Category Adjustment."
  • Consent to Adjust: No work shall begin until the Neighbor explicitly accepts the updated price through the App UI.

2. INTELLECTUAL PROPERTY & USER CONTRIBUTIONS

We own or license all intellectual property rights in our Services (the "Content" and "Marks"). We grant you a non-exclusive, revocable license to access the Services for personal, non-commercial use.

By posting reviews or feedback ("Contributions"), you grant us an unrestricted, irrevocable, perpetual, worldwide license to use, copy, and exploit them. Contributions must be based on firsthand experience and must not contain offensive, discriminatory, or false statements.

3. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make them available. You agree not to:

  • Service Scope Expansion: DASH pros may not perform mechanical repairs; Neighbors may not request unsafe services.
  • Automated Data Collection: No scraping or analyzing platform pricing logic.
  • Identity Impersonation: No AI-generated or fake profile photos.
  • Communication Bypass: No directing communication to personal numbers to bypass the platform's $250 Damage Shield.
  • Evidence Vault Manipulation: No uploading of stock, false, or digitally altered photos.

4. PURCHASES, PAYMENTS, AND REFUNDS

We accept Visa, PayPal, Apple Pay, Google Pay, and Discover. You agree to provide current, complete, and accurate purchase information. All sales are final and no refund will be issued.

5. DISPUTE RESOLUTION & LIABILITY

  • Informal Negotiations: Parties agree to attempt negotiation for at least thirty (30) days before arbitration.
  • Binding Arbitration: Unresolved disputes will be resolved by binding arbitration under AAA rules in DuPage County, Illinois. No class-action basis permitted.
  • Disclaimer: THE SERVICES ARE PROVIDED ON AN AS-IS BASIS. USE AT YOUR SOLE RISK.
  • LIMITATIONS OF LIABILITY: IN NO EVENT WILL WE BE LIABLE FOR DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO $250.00 USD.

6. PLATFORM-SPECIFIC POLICIES

6.1 RIGHT OF ENTRY & PROPERTY AUTHORIZATION

By requesting a "Shine," the Neighbor warrants they own the vehicle or have legal authority. They grant the DASH pro a limited license to enter the property. The Neighbor is solely responsible for securing detailing permission at third-party locations (offices, apartment complexes).

6.2 HAZARDOUS MATERIALS & BIOHAZARD SURCHARGE

DASH pros are not required to handle biohazards (mold, blood, bodily fluids). If a Pro refuses a vehicle due to biohazards, a "Respect the Commute" fee ($25) will be automatically applied to the Neighbor's account.

6.3 MEDIA RIGHTS & OWNERSHIP OF THE "EVIDENCE VAULT"

DETAILERDASH LLC retains ownership of all data in the Evidence Vault. You grant us a license to use media for dispute resolution, quality audits, and marketing. We agree to blur or redact license plates for any public marketing materials.

6.4 FORCE MAJEURE & "CHICAGO WEATHER" LOGIC

We are not liable for delays caused by Acts of God, including extreme heat (>95°F), heavy rain, or snow. DASH pros reserve the right to reschedule a service if environmental conditions risk worker safety or chemical integrity.
